A Former Military Prosecutor Can Make All The Difference In The World
If you are in the Albuquerque, Los Lunas, Bernalillo and Rio Rancho area and you are charged with DWI, call me for a free, no-pressure consultation at (505) 750-8442 to make sure your rights are protected.
And the most important thing to do right now is request your Motor Vehicle Division (MVD) hearing! You have 10 days from the date of arrest for DWI to do this. I’ll explain more later.
Remember you are innocent until proven guilty. During this stressful time, it may seem that everyone is against you. This is why now more than ever to need to hire an Albuquerque DWI Attorney with experience to handle your case immediately.
What are the consequences if you do not hire the right lawyer for your case? It can affect your job, your status in the community, your church, your ability to volunteer with certain organizations. As you can tell, there are real consequences if you are convicted of DWI…and I can help.
In DWI cases, the state must prove that while operating a personal or commercial vehicle, you were intoxicated. This is not as easy as it sounds. The state must show the traffic stop, standard field sobriety, BAC or blood tests were good. When I represent you, I will ensure the state lives up to their burden.
Your charge is no-walk-in-the-park and will not be resolved without some hard work, but I will aggressively represent your side of the story. I will look for weaknesses in the arrest and focus on an acquittal. As a last result, I will work with the DA to help obtain the best outcome possible.
What You Are Facing
Motor Vehicle Division Hearing – Upon arrest, the police officer issued you a notice of driving license revocation. This does not mean you cannot drive, but you must request a hearing from MVD within 10 days of the notice of driver’s license revocation to fight your right to maintain an unrestricted driver’s license. This date is extremely important.
Criminal Case – Based on the number of previous DWIs, a person convicted will face either a misdemeanor or a felony DWI charge.
Misdemeanor DWIs are for DWI offenses 1 through 3.
Felony DWIs are for DWI offenses of 4 or more.
A conviction on either may include substantial fines, mandatory training, community services and jail time. If you want to drive, an interlock device is required. You need to schedule a free consultation with me by calling (505) 750-8442 to learn how I can protect your rights.
